A very shocking but truth revealing news was
published by India today and then respective office holders gave their
justifications and views on it as per their concern and interests.
Crime against women: Over 7,000 FIRs, but only 1 convicted
The police have
revealed that 7,124 FIRs have been lodged of atrocities on women till August
2015, out of which only one case was decided.
Police
officer Mishra also wrote, "Proximity to the affluent and the
under-privileged urban anonymity encouraging deviant behaviour, loosening of
social structures and family control and adverse sex ratio - all have
significant roles as criminogenic factors."
However,
countering this view, Maliwal said, "This may not be the best approach by
the Delhi Police, because even if the crime is being carried out by a person
known to the victim - at home or the workplace - police have as significant a
role to play as in any other crime. The role of the police becomes paramount in
promptly registering a case, conducting effective investigation and filing
charge-sheets in a proper and time-bound manner." She also pointed out
that chargesheets are yet to be filed in 1,059 cases from 2012; 3,218 cases
from 2013; 7,319 cases from 2014 and 6,800 cases from 2015. Thus, since 2012,
31,446 FIRs were registered, out of which charge-sheets were filed only in
13,050 cases.
Lets us try to analyze it with facts.
Police officer very diplomatically but tried to
answer the real problem behind this. Somewhere if we are not wrong he wanted to
highlight that false cases are increasing and he rounded his answer around
various factors.
But DCW chief countered by showing police the boundaries
of police duty and poor charge sheeting rate. Certain question comes to mind.
Do we want to deploy police at homes of citizens of
this country?
Do we have any doubt in charge sheeting rate in CAW case?
Near about 7000 FIR and only 1 case found to be true
clearly shows police is not getting substance out of those FIR to file a charge
sheet. Is it a joke or what?
Charge sheet filing rate in CAW cases is 91% as per NCRB 2014 data and that too for rape is as high as
95%.

But still we are forcing to believe that CAW is
increasing.
Have we ever thought, What happens to those who are
made accused in CAW cases, as most of them are non bailable so accused has to
get arrested.
Arrests per case in CAW are at least 2 persons in any crime head and in case of 498a and dowry death it is 1.9 and 3 respectively. Below is the data from NCRB 2013 report.

Nobody is concern about the pain and harassment the
accused man has to pass through. FIR’s are lodged, people arrested and cases
remains pending in the court thanks to our judicial system efficiency where
pendency is 85% of all crime heads in IPC (As per NCRB 2014 report, Table 4.5)
and that too for Crime against women is 87.5% (As per NCRB 2014 report, Table
5.6).
And Conviction rate in crime against women is 21.3%,
where for all crimes in IPC it is 45.2% and we have crimes under sections like
498a IPC which have conviction rate as low as 13% and rape with 28% conviction
rate.
Now what does this mean?
80% of Crimes against women cases are
false.
87% of cases in 498a IPC are false.
72% of rape cases are false.
It clearly shows that such laws has become tool to
settle personal scores and harass opponents considering the long judicial
process and arrests and humiliation involved in it. FIR’s are always lodged
on mere statements of women and if these FIR’s are not getting converted to CS
that means FIR’s are false. But we want to justify as we want to host the flag
of women empowerment. It is women empowerment and biased laws that is
destroying many families due to being trapped in cases as there is no
punishment for those who file false cases. Who will limit on these rising
number of FIR’s which are false?
Various times courts have shown concerns by just
statements but no punishment given most of the times.

Definitely we need to look at this very seriously it
seems as if we are our self motivating law abusers to file false cases without
fear.
