Dowry harassment case on dead man.

In our country we have near about 50 women centric biased laws like 498a IPC (dowry harassment), PWDV (domestic violence), CRPC 125, 354 IPC, 376 IPC and many more, the list is long.

The greatness of biased laws is that all the government agencies (police and judiciary) involved in process are bound to consider everything a woman states as true. It initiates the machinery with registration of FIR and rest follows. Police hardly cares for investigation in such matters and forward maximum of them to court by filling charge sheets against all the accused. Now comes the turn of our great judiciary which has a huge pendency of cases. In Crime against women category alone it ended last year with 87% pendency.

Not surprisingly a fresh matter came into news which is not new in its type, although many of its ingredients seem illogical or imaginary but that’s how this crime against women cases goes. A dead man and his family are accused of dowry harassment and case was registered. The case is about Late Rakesh Pilania who was a pass out of IIT Roorkee and was working in Royal Bank of Scotland, Gurgaon.


The case was registered against Rakesh and his family at a police station in Hapur, Uttar Pradesh. In the FIR, the woman and her family alleged that Rakesh was mentally ill and he tortured her mentally and physically. They also said he demanded a dowry of Rs 10 lakh.

Rakesh's parents, however, say he was depressed due to the constant fear of being implicated in a fake dowry case. "This took his life. But even his death could not deter her from registering a case against us. This clearly shows the police did not carry out proper investigation before lodging an FIR," said his father Anand Prakash Pilania.


Sad but Rakesh’s parents are part of husband’s family who are never heard. Due to these biased laws it is already well known to law misusers that whatever she will speak it will be considered as truth, yes, if she says 2+2=5 it will be considered truth. Burden of proving allegations false is on accused and opportunity comes after at least 10 years because it is a judicial process and that too drastically slow. Arrest and bail comes first in the priority of this process when cases are in CAW category.

Every year lakhs of innocents are forced to suicide due to this 498a IPC but nobody care, such matters are closed by tagging them as depression or family problems. Remember it is exactly reverse in case of women, there is law 304B IPC called dowry death for it if due to any reason women dies within 7 years of marriage. When such matters comes all the accused are arrested and bail is hardly given to them by court. No involvement of husband and his family required or if it is to be proved that such was the case it will be done years ahead. The death of women is itself sufficient to lend the whole husband’s family in jail for years. But nothing happens if a man dies. Look at the statistics of suicide below.




Questions comes in mind that what if police do its work sincerely?

Forget about this, first there a significantly high level of corruption in police department; I feel if we find any sincere policeman in India we should consider him like God as existence of both in human form is considered very rare.

Second everybody is feared of Mahila Mandal. I was talking to a policeman and asked why he did not wrote truth in investigation report ? He told me his inability that if I do this Mahila Mandal will complain to my seniors and I will get transfer from here, lots of other things like appraisals and increment are linked with disciplinary actions so I can’t risk my career and fate of my family happily settled in city here. Then I realized about how much fear has this feminism has created in the minds of people. Nobody can deny to the statements of a woman, forget about denying registering a FIR.

Who are these Mahila Mandal destroying the families in India?

These are those feminists working in organizations/NGO’s and for so called women empowerment, they conduct candle march, agitations, debates on channels but never speaks when an innocent like Rakesh suicides. They says they work for equality and shape their career as a great social worker but keeps shut when innocent men dies or aquitted from court after a lifelong battle. Politicians also support them as they can be potential vote seekers for them. They never care for those falsely trapped in cases and never advocates for punishment for false cases. I understand fear of punishment will decrease the charm of these biased laws and it will be a great loss to the industry.


In this way the scenario goes on and this 4500 crores of industry keeps on becoming more bigger and bigger on the dead bodies of innocent men.
